These Terms of Service ("Terms") govern your access to and use of Way2Mail's website, platform, APIs, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
If you are using the Services on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms. In such cases, "you" and "your" will refer to the organisation.
By creating an account or using Way2Mail's services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use our Services. Way2Mail's services are designed for business and enterprise use.
You are responsible for maintaining the confidentiality of your account credentials, including API keys and SMTP credentials. You agree to immediately notify Way2Mail of any unauthorised use of your account. We recommend enabling multi-factor authentication for all accounts.
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.
You agree to use Way2Mail's Services only for lawful purposes and in compliance with all applicable laws and regulations. You must NOT use our Services to:
Way2Mail maintains a strict zero-tolerance spam policy. Violations may result in immediate account suspension and legal action.
As a client using Way2Mail's platform, you are responsible for:
Way2Mail offers volume-based pricing. All plans include full access to our platform features, dedicated IP addresses, and expert support. Current pricing is available on our Pricing page.
Fees are billed monthly or annually based on your selected plan. Payment is due as per the terms specified in your invoice. All fees are quoted in US Dollars (USD) or Indian Rupees (INR) unless otherwise specified. Prices are exclusive of applicable taxes (GST).
If your email volume exceeds your plan limit in a given billing period, overage charges will apply at rates specified in your service agreement. We will notify you when you reach 80% and 100% of your plan volume.
All content, features, and functionality of Way2Mail's Services — including but not limited to software, design, text, graphics, logos, and APIs — are owned by Way2Mail and are protected by intellectual property laws.
You retain all rights to the content you send through our platform. You grant Way2Mail a limited, non-exclusive licence to process and transmit your content solely for the purpose of delivering your emails.
Way2Mail commits to providing reliable service for all paid plans. Specific service level commitments including uptime, delivery speed, and support response times will be defined in your individual service agreement. If we fail to meet the agreed commitments, you may be eligible for service credits as outlined in your service agreement.
While we work hard to deliver a reliable service, Way2Mail is not responsible for indirect, incidental, special, consequential, or punitive damages — this includes things like lost profits, lost data, missed business opportunities, or loss of goodwill.
All payments made to Way2Mail are final and non-refundable. When you confirm a plan, we immediately begin provisioning dedicated infrastructure for your account, which is why we are unable to process refunds once a plan is active.
In any event, Way2Mail's total liability for any claim related to these Terms or the Services is limited to the amount you paid us in the calendar month during which the issue occurred.
You agree to indemnify, defend, and hold harmless Way2Mail, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
You may terminate your account at any time by contacting our support team. Upon termination, you will be billed for any outstanding usage through the date of termination.
We may suspend or terminate your access to the Services immediately if:
Upon termination, your right to use the Services will cease immediately. You may request an export of your data before termination takes effect. Once your subscription ends, your account data, email content, recipient lists, and delivery logs will be deleted as there is no active subscription. Billing records may be retained for a limited period for business and accounting purposes, after which they are permanently deleted.
Way2Mail is committed to protecting all data entrusted to us. We process client data solely for the purpose of providing our services and do not use it for our own marketing or sell it to third parties. These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.
Way2Mail reserves the right to modify these Terms at any time. We will notify you of material changes in advance by sending a notice to your registered email address or posting a notice on our website. Your continued use of the Services after the effective date of revised Terms constitutes acceptance of the changes.
